These Terms of Service ("Terms") govern your use of Osyren Studio — the web and mobile application for AI-assisted music and video creation ("the Service"), operated by KDN Estate SRL ("Osyren", "we", "us"), established in Romania.

By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

The English version of these Terms is the governing version. The Romanian version is provided for convenience.

You must be at least 18 years old to create an account and use Osyren Studio.

You are responsible for your account and for keeping your credentials safe. One person per account; you may not sell, rent or share your account.

Osyren Studio lets you generate songs, covers and music videos using artificial-intelligence models, manage your creations, and optionally publish them to a public community feed.

The Service consumes credits for generations (see section 5).

All music, video, images, lyrics and other outputs ("Generations") are produced by artificial-intelligence technology. AI systems are probabilistic: results can contain errors, artifacts, distorted visuals, mispronounced or inaccurate lyrics, timing issues, or content that differs from what you asked for.

We do not guarantee that any Generation will be accurate, complete, of a particular quality, or fit for any specific purpose. You are responsible for reviewing every Generation before using, sharing or relying on it.

Because AI models learn from broad data, Generations are not guaranteed to be unique — different users may receive similar outputs, and an output may unintentionally resemble existing works, styles, voices or persons. You are responsible for how you use Generations, including checking that your intended use does not infringe third-party rights.

Generations are not professional advice of any kind.

You keep ownership of the content you upload or type into the Service (photos, lyrics, prompts, audio) ("Inputs"). You must have the right to use every Input — do not upload other people's photos, lyrics, recordings or other protected material without permission.

To operate the Service, you grant us a worldwide, non-exclusive licence to host, store, process and transmit your Inputs and Generations, solely to provide and improve the Service.

To the extent permitted by law and by the terms of the underlying AI-model providers, we assign to you the rights we hold over your Generations. You may use your Generations personally and commercially, subject to these Terms and to applicable law.

Generations are paid with credits. Credits can be included in your subscription allowance or purchased as one-time packs. Purchased credits are valid for 90 days from the date of purchase; credits not used within that period expire. Refunds of unused packs are covered in section 6.

Payments are processed by Stripe. We never see or store your full card details.

Prices, pack sizes and the credit cost of each feature are shown in the app before you buy or generate and may change; changes never affect credits you already own.

Each Generation triggers immediate, irreversible costs on third-party AI infrastructure the moment you start it. For this reason, credits spent on a completed or user-initiated Generation are not refundable, whether or not you are satisfied with the artistic result. This is the nature of generative AI — an imperfect result (section 3) is still a delivered service.

EU/EEA consumers: when you buy a credit pack you expressly consent to the immediate performance of the digital service and acknowledge that, once you start spending the purchased credits, you lose the 14-day right of withdrawal for that pack (art. 16(m) of Directive 2011/83/EU; OUG 34/2014 in Romania).

Entirely unused credit packs: you may request withdrawal within 14 days of purchase, and we will refund the full price of the unused pack.

Platform failures: if a Generation fails because of a technical error on our side and credits were deducted, we restore those credits. Contact us within 30 days (see Contact).

How refunds are paid: where a refund is due under this section, we refund the money through Stripe to the original payment method, typically within 5-10 business days after we approve your request. Credit restorations for platform failures are applied directly to your account balance.

How to request a refund: write to hello@osyren.app from the email address of your account and include the purchase date and the Stripe receipt or order reference. We reply to every refund request.

Nothing in this section limits mandatory consumer rights that apply in your country.

Publishing a creation to the Community feed makes it public: any user can view, play, like and see your public profile (name, photo, bio, links, follower counts).

By publishing, you grant us a worldwide, non-exclusive, royalty-free licence to host, display and distribute that creation within the Service for as long as it stays published. You can unpublish at any time.

We may remove content and/or suspend accounts that violate section 8, at our discretion, with or without notice.

You agree NOT to use the Service to:

create or share content that is illegal, defamatory, harassing, hateful, or sexually explicit involving minors (zero tolerance);

•

impersonate real persons, or generate content using someone's face, voice or likeness without their consent (including deepfakes);

•

infringe copyright, trademarks or other rights (e.g. uploading lyrics, music or photos you have no rights to);

•

attempt to bypass credit accounting, rate limits, moderation or security measures;

•

use automated tools to scrape the Service or mass-generate content;

•

mislead others that AI content is human-made where the context makes that deceptive.

We may report unlawful content to competent authorities.

The Service itself — software, design, branding, "Osyren" name and logo — belongs to us and our licensors. These Terms give you no rights over it beyond normal use of the app.

We provide the Service "as is" and "as available". We may modify features, third-party AI models, or suspend the Service for maintenance. We may discontinue features with reasonable notice where required.

You may close your account at any time. We may suspend or terminate accounts that breach these Terms. Purchased, unused credits of terminated accounts are refunded unless termination is due to a serious breach.

To the maximum extent permitted by law, our total liability arising out of the Service is limited to the amounts you paid us in the 12 months before the event giving rise to the claim.

We are not liable for indirect damages, lost profits, or for how you or third parties use Generations.

Nothing limits liability that cannot be limited by law (e.g. intent, gross negligence, or mandatory consumer protections).

These Terms are governed by Romanian law. The Service is operated from Romania and offered globally.

If you are a consumer, you also benefit from the mandatory protections of the law of your country of residence, and you may bring proceedings in your local courts.

Romanian consumers may contact ANPC (Autoritatea Națională pentru Protecția Consumatorilor — anpc.ro; SAL/SOL platforms). EU consumers may use the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr).

We may update these Terms. For material changes we will notify you in the app or by email before they take effect. Continuing to use the Service after the effective date means you accept the new Terms.
